RECONVENED APPEAL HEARING - HEALTH CAPABILITY - J.F.
RESOLVED that:

1. The appeal against the decision to dismiss on the grounds of capability (performance) was not upheld.

2. The appellant be reissued with 12 weeks notice effective from 1st December 2011 to ensure that redeployment was fully considered.

RESOLVED that under Section 100A(4) of the Local Government Act 1972 the public be excluded from the meeting for the following item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Act.

The Chairman introduced the Panel Members and officers to the Parties present.

J.F. was in attendance to state her case and was represented by her Unison representative.

The hearing had been adjourned on the 17th October 2011 for a further referral to Occupational Health.

Additional documentation containing the request made to Occupational Health and reports received had been circulated to all parties in advance of the hearing. The HR Advisor explained the content of the additional documentation following which the management representative and the appellant and her representative were given an opportunity to make a statement on the additional evidence.

The parties were given a further opportunity to summarise their case.
