Members gave consideration to the report, the application to vary and the representations received from the Police and Environmental Health, as set out in the papers, and orally at the meeting.

Members noted an application for variation had been received from Mr Mark Garry, in relation to Jokers, 11 Yarm Lane, Stockton on Tees.

The Applicant, Mr Garry requested that he amend his application to vary with a view to seeking agreement from the Responsible Bodies who had made representations.

Following a short adjournment, Miss Smith on behalf of the Police, confirmed that the Police had no objections to the proposed amendment; and Mr Snowdon for Environmental Health indicated that Environmental Health similarly had no objections provided Annex 2 of the Premise Licence could be amended as detailed below. Accordingly, the Applicant proposed the following amendment to his application to vary:-

• That "live music" be added to the premise license, Monday to Sunday 13:00 to 23:00.

• That "late night refreshment" be varied to:-
- Friday and Saturday 23:00 until 3:00
- Sunday to Thursday 23:00 until 2:30

• That the supply of alcohol on and off premises be varied to:-
- Friday and Saturday 10:30 until 2:30
- Sunday to Thursday 10:30 until 2:00

• That opening hours be amended to read:-
- Friday and Saturday 10:30 until 03:00
- Sunday to Thursday 10.30 until 02:30

• That Annex 2 of the Premise Licence entitled ‘Prevention of Nuisance' be amended to remove Condition 2 and replace with the 3 conditions proposed by Environmental Health at page 32 of the papers.

• That Annex 2 of the Premise Licence, entitled ‘Public Safety' be amended to delete paragraph 1 as this was already a mandatory condition.

Members gave weight to the fact that discussions had taken place between the Applicant, the Police and Environmental Health and the parties had agreed the proposed amendments as set out above.

After giving consideration to all of the evidence and representations made both in writing and orally, the Committee resolved to grant the variation (as amended and detailed above) to the premise licence as requested.
