ROWNTREES, 68 DOVECOT STREET, STOCKTON ON TEES - APPLICATION FOR VARIATION OF A PREMISE LICENCE UNDER THE LICENSING ACT 2003
RESOLVED that the amended application for variation be granted and the following condition be attached to the licence:-

An automatic till generated prompt system shall be maintained at the premises to remind staff to check age and/or Identification on all sales of alcoholic liquor.

The Chairman introduced all persons who were present and explained the procedure to be followed during the hearing.

The Licensing Officer presented the report to the Committee. Consideration was given to the application as outlined in the report. Members noted and gave consideration to the representations that had been received from responsible authorities, namely Cleveland Police and the Council's Trading Standards section. No representations had been received from persons living within the vicinity of the premises. Members also heard oral submissions from Miss Smith on behalf of the Police.

Mr Harvard (Representing the Applicant) confirmed that the application had been varied and the Applicant no longer wished to remove the embedded conditions or the condition relating to the marking of alcoholic products. The only issue for the Committee to consider was with regard to the till generated message system.

Mr Harvard apologised on behalf of the Applicant that they had not been complying fully with the conditions attached to the licence. The Mughals had taken over the premise from the previous owner and were not fully conversant with all of the conditions. Mr Harvard confirmed that the CCTV system was now installed and would be up and running within a matter of days. The labelling is also in the process of been done as the premise has ordered a labelling gun and is awaiting proofs of stickers.

The Committee heard submissions from Miss Smith, Counsel and representative for Cleveland Police.

It was noted that the Police had reached an amicable agreement with the Applicants on the wording of the following condition:-

"An automatic till generated prompt system shall be maintained at the premises to remind staff to check age and/or Identification on all sales of alcoholic liquor"

The Committee had regard to the representation made, a copy of which was circulated to all persons.

In considering their decision members were mindful that the responsible authorities had indicated their agreement to the proposal put forward on behalf of the Applicant.

When considering their decision the Committee had regard to the Statutory guidance issued under Section 182 of the Licensing Act 2003 and the Councils Licensing Policy.

The Committee asked it to be noted that they were concerned that the conditions had not been adhered to and reminded the Applicant that they should make themselves fully aware of all of the conditions attached to the Licence.

Members were informed that as the representation from Environmental Health had been withdrawn the above application had been withdrawn from the agenda.
